Nebraska Sports Betting Bill Clears Committee, Needs Senate Approval for 2026 Ballot

Nebraska's bid to legalize online sports betting has taken a significant step forward as the General Affairs Committee advanced LR20CA to the Senate floor with a 6-2 vote. If successful, voters will decide on the measure in the November 2026 general election.

The constitutional amendment bill, introduced by Sen. Eliot Bostar (D-29), would amend the Nebraska Racetrack Gaming Act to:

  • Allow casinos to offer online sports betting
  • Allocate 90% of tax revenue to property tax relief
  • Enable partnership between six Nebraska casinos and online operators

A companion bill (LB 421) by Sen. Stan Clouse (R-37) outlines the regulatory framework and would remove betting restrictions on in-state colleges. However, this bill remains in committee.

The path to legalization requires:

  • Three separate votes in the unicameral legislature
  • Two-thirds majority (30 of 49 Senators) for each vote
  • Governor's signature
  • Voter approval in 2026

Currently, Nebraska only permits retail sports betting with a 20% tax rate. While some legislators express concerns about expanding gambling, others argue that legislative control over ballot measures is crucial, especially since casinos might pursue a referendum independently, similar to recent events in Missouri.

The measure faces significant hurdles, needing strong legislative support to advance to the 2026 ballot, where voters will make the final decision on Nebraska's online sports betting future.
